18 U.S.C. 2257 Exemption & Content Moderation Policy

1. 18 U.S.C. 2257 Exemption Statement

NightChat24 is an interactive real-time communications service provider. All communications, messages, video feeds, and interactions are live, peer-to-peer user-generated content (UGC) conducted in real time between consenting adults aged 18 and older.

NightChat24 is NOT a producer or creator of visual depictions of actual or simulated sexually explicit conduct as defined by 18 U.S.C. § 2257, 2257A, or 28 C.F.R. Part 75.

Under federal law and statutory exemptions, interactive computer services facilitating live, ephemeral text and WebRTC audio/video communications between users are exempt from the recordkeeping and labeling requirements of 18 U.S.C. § 2257.

2. Zero Tolerance for Child Sexual Exploitation (CSAM)

NightChat24 strictly and unequivocally prohibits any material depicting, describing, or involving minors or persons under 18 years of age. We maintain absolute zero tolerance for Child Sexual Abuse Material (CSAM) and child exploitation.

Any user attempting to upload, share, or solicit prohibited content involving minors will have their access instantly and permanently terminated, and relevant identifying information, including connection metadata and timestamps, will be reported to the National Center for Missing & Exploited Children (NCMEC) and appropriate international law enforcement agencies pursuant to 18 U.S.C. § 2258A.

3. Non-Consensual Imagery & Harassment

We prohibit non-consensual sexual content, including 'revenge pornography', doxxing, voyeurism, blackmail, and unconsented recording of live video feeds.

Every member has real-time access to in-chat blocking and abuse reporting mechanisms. Reported accounts are audited immediately by our automated filtering systems and moderation team.
